CSNNE.com reports that earlier today, Judge Richard Berman stated that a settlement has not been reached in the scandalous Tom Brady Deflategate case. According to ESPN, the current issue is Brady’s appeal of his four-game suspension for his ties to Deflategate.

The judge has praised both sides of the case for their “willingness” to try to meet in the middle and settle their case, but now he has said that he will have to issue a decision “tomorrow or the day after.”

In July, it was determined that Brady would still face a four-game suspension.

Brady seemed to be in a chipper mood, chitchatting with DeMaurice Smith, NFLPA Executive Director. Brady was notably happier than he was at the settlement conference on August 12. However, the NFL seemed a bit quieter and more reserved.

Last year, Dan Marino sued the NFL.

NBC News adds that the trouble started when Brady and two employees allegedly let air out of footballs before January’s AFC championship game, supposedly to make them easier for Brady to hold.
