McGurk has worked with clients from all levels, including law Fortune 100 companies to small startups. He has provided these companies with advice in global portfolio development, due diligence matters, and adversarial proceedings such as litigation, reexaminations, and interferences. He mostly works with pharmaceutical, medical device, chemical, robotics, and mechanical technology industries.
He had given strategic litigation counseling support to clients due to his background as a patent examiner in the chemical arts for the United States Patent and Trademark Office. His clients frequently file in the district courts across the nation, handling numerous patent matters that go before the Patent Trial and Appeal Board of the USPTO. His experience with due diligence involved pre-litigation, in-license, acquisition, design around and validity, patentability matters, and freedom-to-operate product and/or process clearance.
McGurk is joining DLA Piper from Finnegan, Henderson, Farabow, Garret & Dunner LLP. There he was the Boston office’s managing partner. He currently serves as the co-chair of the IP Law Committee for the Boston Bar Association.
McGurk earned his J.D. from George Washington University, National Law Center and his B.S. from the University of Delaware in Chemical Engineering.
