Court Orders Apple to Disclose HTC Deal Details to Samsung

On Wednesday, Judge Lucy Koh ordered that Apple produce a full unredacted copy of the settlement agreement between Apple and HTC “without delay” to Samsung, subject to Attoneys-Eyes-Only conditions. The order is part of post trial arguments following a $1.05 billion verdict Apple won against Samsung. The settlement agreement between Apple and HTC is a 10-year patents licensing agreement.

Samsung has argued that it is “almost certain” the HTC deal includes essentially many of the same patents that are involved in its own litigations with Apple. It is also possible that the pricing of the patents made between Apple and HTC can provide Samsung with an argument that the jury award against it was too high as evinced by the price Apple put on its own patents that had been held violated with consequent damages.

Legal analysts are of the opinion that if Samsung can manage to glean something of worth from the agreement, it may still be able to prevent the sales ban of its products in the US. According to court documents, in its latest salvo against Apple, Samsung has also requested the court to add the latest Apple products – the iPod Touch 5, the iPad 4 and the iPad mini to the list of devices supposed to have infringed upon Samsung’s patents.

  1. Of all the stupid, boneheaded calls. There is no benefit to Apple and the only foreseeable benefit to Samsung is it gives them the opportunity to copy anything they may haver missed the first time Apple showed them patents. This decision would be just as wrong if Apple and Samsung’s positions were reversed.
