Miami Judge Rejects “Piggybacking” Discrimination Lawsuit Against Wal-Mart

A Miami federal judge has rejected a discrimination lawsuit by women employees against Wal-Mart Stores Inc. The judge says that the women employees were “improperly ‘piggybacking’ on a national class action that was rejected by the U.S. Supreme Court. An attorney representing 11 women named in the suit will try to attain reconsideration of the dismissal. District Judge Robert Scola will be asked to certify a question to the U.S. Court of Appeals for the 11th Circuit.

Judge Scola dismissed the case on Monday, citing that the case “duplicated the Dukes v. Wal-Mart claims that were rejected by the Supreme Court in 2011, according to Ct Law Tribute. The Dukes ruling established that the women couldn’t sue as a group “because the evidence didn’t support their claim of a general policy of discrimination against Wal-Mart. The lawsuit was filed on behalf of women workers at Wal-Mart in Florida, North Carolina, Virginia and four other southeastern states. Judge Scola commented, “plaintiffs cannot assert class claims that were previously asserted and rejected.”

Representing America’s largest retailer was Hilarie Bass, co-president of Greenberg Traurig. She was not available for comment. Wal-Mart’s spokesman Randy Hargrove was able to comment; he says that the company’s position is that it believes its employees should bring cases separately. “We are pleased the district court in Florida dismissed this class action. Five trial courts have unanimously concluded that these regional gender discrimination class action claims are not appropriate. We have said all along if someone feels they have been treated unfairly, they deserve to have their timely individual claim heard in court.”

There is a devastating problem stripping our great American workers of their civil and basic human rights, their freedom, liberty, and right to justice under the law, and one might say their very honor and dignity across our nation today. I am writing you to ask for your help please. Your country, our people, your great American brothers and sisters across this nation are suffering more and more lately from the catastrophic and devastating effects of massive, gross, systematic corporate corruption on our American culture, society, workplace, life and liberty today. Prior to my recent very detailed in depth personal tragic experience with this problem I had a naive faith and trust in our government for the people. I had turned my life around from years of alchoholism and self abuse and dedicated myself to doing the right thing, helping and encouraging others, and being a positive effect on my surroundings and those around me, such as where I worked at Walmart for 10 years. Everything was going fine, until one day at work when I heard this hysterical crying and responded to find that the new manager was abusively bullying a handicapped female colleague. As bad as that was I was even more disturbed to find that although many employees who had witnessed and heard this were visibly shaken, they were all afraid to report it. After that, things were never the same for me again. The manager began complaining to me about reporting him, harssed and physically threatened me, and wrongfully fired me. The NLRB put a charge on Walmart for illegaly firing me for engaging in protected activity and I was then reinstated in exhange dropping the charge. Upon returning to work I was continually plotted, schemed, and retaliated on in many ways and wrongfully fired twice more. It would take me 100 pages at least to explain the gruelling legal battle and everything from there, but in very brief summary let me just say that despite absolute documented proof of numerous civil, labor, and serious federal violations and crimes against me which caused me to lose my job, my well being, 10 of the last prime years of my life invested in the company, any hope of ever retiring in my life, and damages I will suffer for as long as I live, even with 3 lawyers, A congressman, and the ploice who provided a statement proving walmart told intentional defamatory lies to federal investigators all backing me, I still lost by what can only be described as complete gross corporate corruption so bad that before it was all over DC gov’t officials who had tried, but were unable to help me were calling to apologize for the terrible injustice I was suffering due to what they called “such a flawed system”. Even after one of the highest officials involved in my case was outright busted for corruption for helping walmart avoid charges while himself owning considerable walmart stock, I still got no reconsideration and that official went unpunished. What is going on here sir? The unimaginable ramifications of such a system where Employees of our nations largest employer are living and working in such a paralyzing state of fear and total distrust of their employer and government that they will watch and listen to the Walmart managers abusive bullying and hysterical crying of a handicapped female colleague and be too afraid to speak-up, knowing that what happened to me will happen to them. They will be fired, have no recourse and not be able to feed their own childen. The home of the free and the brave, with liberty and justice for all? The truth is, Walmart employees have no civil rights, no basic inherent human rights, and no hope or chance for justice under the law in America today, and we have no way of knowing or having any real statistics on what types of illegal mistreatment is going on in Walmart stores across the country everyday, because due to the catastrophic and devastating effects of massive gross systematic corporate corruption on our American culture, society, workplace, life and liberty today, they are afraid to tell us, report anything, or speak up. I love my people sir, my great American brothers and sisters of every, race, color, origin, and orientation across this land, but my patriotic faith in my government for the people is understandibly gone. There is nothing to be proud of in a government that throws it’s people, it’s most average American citizen wokers today under the bus, in favor of evil, greedy corporate interests and corruption..
